These Terms and Conditions ("Terms") govern your use of The Big Tree Company's website and services. Please read them carefully before using our Site or booking any service.
By accessing or using the website at thebigtreecompany.ca (the "Site") or engaging The Big Tree Company for any services, you agree to be bound by these Terms and Conditions. If you do not agree, please do not use our Site or services.
These Terms apply to all visitors, customers, and others who access or use the Site.
The Big Tree Company provides large tree planting, tree moving, and tree removal services in Alberta, Canada, within approximately 150 km of Sundre, AB. All services are subject to a site assessment, written quote, and signed agreement prior to commencement.
We reserve the right to decline any project at our discretion, including projects where site conditions, access, or safety concerns make the work impractical or unsafe.
All quotes provided by The Big Tree Company are written and itemized. Verbal estimates are not binding. A written quote is valid for 30 days from the date of issue unless otherwise stated.
Final pricing may be adjusted if site conditions differ materially from those described or observed during the assessment, or if the scope of work changes at the customer's request.
A deposit may be required to secure a project date. Deposit terms will be outlined in your written quote.
Cancellations made more than 5 business days before the scheduled project date will receive a full refund of any deposit paid.
Cancellations made within 5 business days of the scheduled date may forfeit the deposit, as equipment and crew scheduling costs will have been incurred.
We reserve the right to reschedule projects due to weather, equipment availability, or other circumstances beyond our control. We will provide as much notice as possible and work with you to find an alternative date.
You agree to:
• Provide accurate information about your property, including any known underground utilities, irrigation systems, or other buried infrastructure
• Ensure adequate access to the work site for our equipment (minimum access widths will be specified in your quote)
• Obtain any necessary permits, HOA approvals, or municipal authorizations prior to the project date
• Be present or have an authorized representative available on the day of service
The Big Tree Company is not liable for damage to undisclosed or unmarked underground utilities or infrastructure.
It is the customer's responsibility to ensure that utility locates (Alberta One-Call / Click Before You Dig) have been completed prior to any digging or spade work. We include a utility checklist in our assessment process, but the customer bears ultimate responsibility for ensuring all utilities are marked.
The Big Tree Company will not proceed with spade work until we are satisfied that utility locates have been completed.
Large tree transplanting and planting involves inherent biological risk. While we take every precaution to ensure successful establishment, we cannot guarantee tree survival. Factors outside our control — including drought, disease, pest infestation, improper aftercare, or extreme weather — may affect outcomes.
Any warranty terms specific to your project will be outlined in your written quote and service agreement. General aftercare instructions will be provided at the time of installation.
To the maximum extent permitted by applicable law, The Big Tree Company's total liability for any claim arising from our services or use of this Site shall not exceed the amount paid by you for the specific service giving rise to the claim.
We are not liable for indirect, incidental, consequential, or punitive damages, including loss of profits, loss of data, or property damage not directly caused by our negligence.
All content on this Site — including text, images, logos, graphics, and videos — is the property of The Big Tree Company or its licensors and is protected by Canadian and international copyright law.
You may not reproduce, distribute, or use any content from this Site for commercial purposes without our prior written consent.
You agree to use this Site only for lawful purposes and in a manner that does not infringe the rights of others. You must not:
• Attempt to gain unauthorized access to any part of the Site or its systems
• Transmit any harmful, offensive, or disruptive content
• Use automated tools to scrape or harvest data from the Site
We reserve the right to suspend or terminate access to the Site for any user who violates these Terms.
These Terms and Conditions are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein. Any disputes arising from these Terms or our services shall be subject to the exclusive jurisdiction of the courts of Alberta.
